Destin\u00e9 \u00e0 s\u00e9curiser <strong>le bailleur<\/strong> contre d\u2019\u00e9ventuels manquements du <strong>locataire<\/strong>, il est pourtant souvent source de confusion, notamment lorsqu\u2019un bail \u00e9volue dans le temps.<\/p>\n\n\n\n<p><strong>La r\u00e9\u00e9valuation de la caution<\/strong> est encadr\u00e9e par la loi, et toute erreur peut exposer <strong>le bailleur<\/strong> \u00e0 un litige ou \u00e0 une restitution forc\u00e9e.<\/p>\n\n\n\n<p>Cet article fait le point sur les r\u00e8gles applicables en <strong>France<\/strong>, les cas autoris\u00e9s ou interdits, les diff\u00e9rences avec <strong>la r\u00e9vision du loyer<\/strong> et les bonnes pratiques pour rester conforme, notamment gr\u00e2ce \u00e0 <a href=\"https:\/\/www.smovin.app\/fr-fr\/\"><strong>des outils de gestion locative comme Smovin<\/strong><\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"quest-ce-que-le-depot-de-garantie\"><a href=\"#quest-ce-que-le-depot-de-garantie\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Qu\u2019est-ce que le d\u00e9p\u00f4t de garantie ?<\/h2>\n\n\n\n<p><strong>Le <\/strong><a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/F31269\"><strong>d\u00e9p\u00f4t de garantie<\/strong><\/a> (ou commun\u00e9ment appel\u00e9 \u00ab caution \u00bb) est une somme vers\u00e9e au <strong>bailleur<\/strong> par <strong>le locataire<\/strong> au moment de <strong>la signature du bail<\/strong>. Il vise \u00e0 couvrir d\u2019\u00e9ventuels manquements \u00e0 ses obligations, tels que :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.smovin.app\/fr-fr\/degradation-bien-locatif\/#recourir-a-la-caution-ou-a-la-garantie-locative\"><strong>d\u00e9gradations constat\u00e9es<\/strong><\/a> lors de l\u2019\u00e9tat des lieux de sortie,<\/li>\n\n\n\n<li><strong>loyers<\/strong> ou <strong>charges impay\u00e9s<\/strong>,<\/li>\n\n\n\n<li>r\u00e9parations locatives non effectu\u00e9es.<\/li>\n<\/ul>\n\n\n\n<p>Contrairement \u00e0 certaines pratiques, <strong>le d\u00e9p\u00f4t de garantie<\/strong> n\u2019est ni un acompte ni un dernier mois de <strong>loyer<\/strong>, et il ne peut \u00eatre conserv\u00e9 sans justification.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"montant-legal-du-depot-de-garantie\"><a href=\"#montant-legal-du-depot-de-garantie\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Montant l\u00e9gal du d\u00e9p\u00f4t de garantie<\/h3>\n\n\n\n<p>Pour <strong>les baux d\u2019habitation<\/strong> soumis \u00e0 <strong>la <\/strong><a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/JORFTEXT000000509310\/2023-04-27\/\"><strong>loi du 6 juillet 1989<\/strong><\/a>, le montant du <strong>d\u00e9p\u00f4t de garantie<\/strong> doit \u00eatre le suivant :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Location vide : maximum 1 mois de loyer hors charges<\/li>\n\n\n\n<li><a href=\"https:\/\/www.smovin.app\/fr-fr\/location-meuble\/\">Location meubl\u00e9e<\/a> : maximum 2 mois de loyer hors charges<\/li>\n<\/ul>\n\n\n\n<p>Ce plafond est strict et constitue une base essentielle pour comprendre les limites de toute r\u00e9\u00e9valuation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"peut-on-reevaluer-un-depot-de-garantie-en-cours-de-bail\"><a href=\"#peut-on-reevaluer-un-depot-de-garantie-en-cours-de-bail\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Peut-on r\u00e9\u00e9valuer un d\u00e9p\u00f4t de garantie en cours de bail ?<\/h2>\n\n\n\n<p>En r\u00e8gle g\u00e9n\u00e9rale, <strong>le d\u00e9p\u00f4t de garantie<\/strong> ne peut pas \u00eatre r\u00e9\u00e9valu\u00e9 <strong>en cours de bail<\/strong>, m\u00eame si le loyer augmente suite \u00e0 <strong>une indexation<\/strong> ou une r\u00e9vision l\u00e9gale.<\/p>\n\n\n\n<p>Le montant du <strong>d\u00e9p\u00f4t<\/strong> est fig\u00e9 \u00e0 <strong>la signature du contrat<\/strong>, sur la base du <strong>loyer initial<\/strong>.<\/p>\n\n\n\n<p>Une hausse du <strong>loyer<\/strong> n\u2019autorise pas automatiquement <strong>le bailleur<\/strong> \u00e0 demander un compl\u00e9ment de <strong>d\u00e9p\u00f4t de garantie<\/strong>. Cette r\u00e8gle vise \u00e0 prot\u00e9ger <strong>le locataire<\/strong> contre des demandes financi\u00e8res impr\u00e9vues et \u00e0 garantir la stabilit\u00e9 contractuelle.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"dans-quels-cas-la-reevaluation-est-elle-interdite-ou-strictement-encadree\"><a href=\"#dans-quels-cas-la-reevaluation-est-elle-interdite-ou-strictement-encadree\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Dans quels cas la r\u00e9\u00e9valuation est-elle interdite ou strictement encadr\u00e9e ?<\/h3>\n\n\n\n<p>La loi interdit explicitement toute <strong>r\u00e9\u00e9valuation du d\u00e9p\u00f4t de garantie<\/strong> dans les situations suivantes :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Indexation annuelle du loyer (IRL)<\/strong><\/li>\n\n\n\n<li>R\u00e9vision triennale ou conventionnelle<\/li>\n\n\n\n<li><strong>R\u00e9gularisation des charges<\/strong><\/li>\n\n\n\n<li>Changement de propri\u00e9taire en cours de bail<\/li>\n<\/ul>\n\n\n\n<p>M\u00eame si le loyer augmente de mani\u00e8re significative, <strong>le d\u00e9p\u00f4t de garantie<\/strong> reste inchang\u00e9, sauf exceptions tr\u00e8s limit\u00e9es.<\/p>\n\n\n\n<p>En tant que <strong>bailleur<\/strong>, toute demande injustifi\u00e9e vous expose \u00e0 :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>une contestation du locataire,<\/li>\n\n\n\n<li>une obligation de remboursement,<\/li>\n\n\n\n<li>voire des sanctions en cas de pratique abusive.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"les-situations-ou-un-ajustement-peut-etre-envisage\"><a href=\"#les-situations-ou-un-ajustement-peut-etre-envisage\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Les situations o\u00f9 un ajustement peut \u00eatre envisag\u00e9<\/h3>\n\n\n\n<p>Bien que le principe soit strict, certaines situations permettent indirectement d\u2019<strong>adapter le d\u00e9p\u00f4t de garantie<\/strong>. Voici un aper\u00e7u de ces cas particuliers.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"renouvellement-ou-nouveau-bail\"><a href=\"#renouvellement-ou-nouveau-bail\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Renouvellement ou nouveau bail<\/h4>\n\n\n\n<p>Lorsqu\u2019<strong>un nouveau bail<\/strong> est sign\u00e9 (fin du bail pr\u00e9c\u00e9dent et nouveau contrat), <strong>le d\u00e9p\u00f4t de garantie<\/strong> peut \u00eatre recalcul\u00e9 sur la base du <strong>nouveau loyer<\/strong>, dans la limite des plafonds l\u00e9gaux.<\/p>\n\n\n\n<p>Cela concerne notamment :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>un <strong>changement de locataire<\/strong>,<\/li>\n\n\n\n<li>un <strong>nouveau contrat<\/strong> apr\u00e8s r\u00e9siliation,<\/li>\n\n\n\n<li>un renouvellement avec modification substantielle du bail.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"passage-dune-location-vide-a-meublee\"><a href=\"#passage-dune-location-vide-a-meublee\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Passage d\u2019une location vide \u00e0 meubl\u00e9e<\/h4>\n\n\n\n<p>En cas de changement de r\u00e9gime locatif, avec signature d\u2019un nouveau contrat, le <strong>d\u00e9p\u00f4t<\/strong> peut \u00eatre ajust\u00e9 dans la limite de <strong>2 mois de loyer<\/strong> hors charges.<\/p>\n\n\n\n<p>L\u00e0 encore, cela suppose <strong>un nouveau bail<\/strong>, et non un simple avenant.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"recours-du-locataire-en-cas-daugmentation-abusive-du-depot-de-garantie\"><a href=\"#recours-du-locataire-en-cas-daugmentation-abusive-du-depot-de-garantie\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Recours du locataire en cas d\u2019augmentation abusive du d\u00e9p\u00f4t de garantie<\/h2>\n\n\n\n<p>Si le <strong>bailleur<\/strong> d\u00e9cide d\u2019augmenter <strong>le d\u00e9p\u00f4t de garantie<\/strong> sans respecter les r\u00e8gles l\u00e9gales, le <strong>locataire<\/strong> dispose de plusieurs recours pour contester cette augmentation.&nbsp;<\/p>\n\n\n\n<p>Tout d\u2019abord, il peut demander une explication \u00e9crite du <strong>propri\u00e9taire<\/strong>, notamment sur la base juridique justifiant cette hausse. En cas de refus ou d\u2019absence de r\u00e9ponse satisfaisante, le <strong>locataire<\/strong> peut saisir la <strong>Commission D\u00e9partementale de Conciliation<\/strong> (CDC) afin de tenter une r\u00e9solution amiable du diff\u00e9rend.&nbsp;<\/p>\n\n\n\n<p>Si cette d\u00e9marche n\u2019aboutit pas, le <strong>locataire<\/strong> peut porter l\u2019affaire devant le <strong>tribunal judiciaire<\/strong>, qui appr\u00e9ciera la l\u00e9galit\u00e9 de l\u2019augmentation et pourra ordonner la restitution de la somme ind\u00fbment demand\u00e9e.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"depot-de-garantie-revision-de-loyer-et-charges-ne-pas-confondre\"><a href=\"#depot-de-garantie-revision-de-loyer-et-charges-ne-pas-confondre\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>D\u00e9p\u00f4t de garantie, r\u00e9vision de loyer et charges : ne pas confondre<\/h2>\n\n\n\n<p>Une confusion fr\u00e9quente chez les <strong>propri\u00e9taires<\/strong> consiste \u00e0 assimiler le <strong>d\u00e9p\u00f4t de garantie<\/strong> aux autres m\u00e9canismes financiers du bail.
