Il a ensuite la possibilit\u00e9 de les sous-louer \u00e0 un tiers, devenant ainsi &#8220;sous-bailleur&#8221;. Il est donc crucial de v\u00e9rifier les clauses du bail professionnel initial pour \u00e9viter toute situation litigieuse.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"quelles-sont-les-conditions-pour-la-sous-location-dun-bail-professionnel\"><a href=\"#quelles-sont-les-conditions-pour-la-sous-location-dun-bail-professionnel\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Quelles sont les conditions pour la sous-location d\u2019un bail professionnel ?<\/h2>\n\n\n\n<p>Pour qu\u2019une sous-location professionnelle soit l\u00e9gale, il faut remplir plusieurs conditions :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Obtenir une autorisation du bailleur<\/strong> : L\u2019article 1717 du Code civil pr\u00e9cise que la sous-location est interdite sauf autorisation expresse du propri\u00e9taire. Le locataire principal doit donc obtenir l\u2019autorisation \u00e9crite du propri\u00e9taire, et celle-ci est g\u00e9n\u00e9ralement sp\u00e9cifi\u00e9e dans le bail initial.&nbsp;<\/li>\n\n\n\n<li><strong>Un contrat de sous-location conforme<\/strong> : La relation entre le locataire principal et le sous-locataire doit \u00eatre r\u00e9gie par un contrat en bonne et due forme, pr\u00e9cisant les modalit\u00e9s de la sous-location (dur\u00e9e, loyer, obligations des parties, etc.). Pour \u00eatre valide, elle doit respecter plusieurs r\u00e8gles pr\u00e9cises, notamment en ce qui concerne sa dur\u00e9e, la fixation du loyer et les obligations des parties, afin d\u2019\u00e9viter tout litige.<\/p>\n\n\n\n<p>La dur\u00e9e de la sous-location ne peut en aucun cas exc\u00e9der celle du bail principal. Il est donc imp\u00e9ratif de veiller \u00e0 ce que la sous-location prenne fin avant ou en m\u00eame temps que le bail initial.&nbsp;<\/p>\n\n\n\n<p>Concernant la fixation du loyer, son montant est librement n\u00e9goci\u00e9 entre le locataire principal et le sous-locataire.
