En r\u00e9alit\u00e9, elle joue un r\u00f4le cl\u00e9 dans <strong>la gestion locative<\/strong>.<\/p>\n\n\n\n<p>Elle permet d\u2019<strong>adapter progressivement le loyer<\/strong> \u00e0 l\u2019\u00e9volution du <strong>co\u00fbt de la vie<\/strong>, en s\u2019appuyant sur <strong>un indicateur officiel<\/strong> : <a href=\"https:\/\/statbel.fgov.be\/fr\/themes\/prix-la-consommation\/indice-sante\"><strong>l\u2019indice sant\u00e9<\/strong><\/a>. Cet indice refl\u00e8te <strong>l\u2019inflation r\u00e9elle<\/strong>, tout en excluant certains produits volatils.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pour <strong>le bailleur<\/strong>, cela permet de maintenir <strong>la coh\u00e9rence \u00e9conomique du bail<\/strong> dans le temps.<\/li>\n\n\n\n<li>Pour <strong>le locataire<\/strong>, cela garantit <strong>un cadre transparent et pr\u00e9visible<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Mais attention : ce m\u00e9canisme est <strong>strictement encadr\u00e9<\/strong>. Il ne peut \u00eatre appliqu\u00e9 que si :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>une <strong>clause d\u2019indexation<\/strong> est pr\u00e9vue dans <strong>le<\/strong> <strong>bail<\/strong>,<\/li>\n\n\n\n<li><strong>le<\/strong> <strong>bail<\/strong> est correctement <strong>enregistr\u00e9<\/strong>,<\/li>\n\n\n\n<li><strong>une demande explicite<\/strong> est faite au <strong>locataire<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Sans cela, toute <strong>indexation<\/strong> peut \u00eatre remise en cause.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" glyphicon-link\"><\/i><\/a>Quel impact concret sur vos revenus locatifs ?<\/h3>\n\n\n\n<p>Derri\u00e8re son aspect technique, <strong>l\u2019indexation<\/strong> a un effet direct sur <strong>la performance financi\u00e8re<\/strong> de <strong>votre investissement<\/strong>. <a href=\"https:\/\/www.smovin.app\/fr-be\/fonctionnalites\/indexation-automatisee\/\"><strong>Un loyer non index\u00e9<\/strong><\/a> pendant plusieurs ann\u00e9es peut entra\u00eener une perte significative de revenus, parfois difficile \u00e0 rattraper en raison <strong>des r\u00e8gles de <strong>l\u2019\u00e9volution du march\u00e9<\/strong> sans avoir \u00e0 ren\u00e9gocier <strong>le bail<\/strong> ou \u00e0 changer de <strong>locataire<\/strong>.<\/p>\n\n\n\n<p>\u00c0 titre d\u2019exemple, un loyer de <strong>800 \u20ac non index\u00e9<\/strong> pendant <strong>3 ans<\/strong> dans un contexte inflationniste peut repr\u00e9senter <strong>plusieurs centaines d\u2019euros<\/strong> de manque \u00e0 gagner cumul\u00e9s.<\/p>\n\n\n\n<p>Pour <strong>les gestionnaires<\/strong> ou <strong>les bailleurs multi-biens<\/strong>, cet effet est encore plus marqu\u00e9 \u00e0 l\u2019\u00e9chelle d\u2019un portefeuille. <strong>L\u2019indexation<\/strong> devient alors <strong>un levier strat\u00e9gique<\/strong> pour pr\u00e9server la rentabilit\u00e9 globale et anticiper <strong>les \u00e9volutions de revenus<\/strong>.<\/p>\n\n\n\n<p>Cela confirme une chose : au-del\u00e0 de <strong>l\u2019obligation l\u00e9gale<\/strong>, <strong>l\u2019indexation<\/strong> doit \u00eatre int\u00e9gr\u00e9e comme <strong>un outil de pilotage financier<\/strong> \u00e0 part enti\u00e8re.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"les-restrictions-peb-un-tournant-entre-2022-et-2023\"><a href=\"#les-restrictions-peb-un-tournant-entre-2022-et-2023\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Les restrictions PEB : un tournant entre 2022 et 2023<\/h2>\n\n\n\n<p>Face \u00e0 <strong>la hausse de l\u2019inflation<\/strong> et aux <strong>enjeux \u00e9nerg\u00e9tiques<\/strong>, les trois r\u00e9gions belges ont mis en place des <strong>mesures temporaires<\/strong> limitant <strong>l\u2019indexation des loyers<\/strong> pour les logements les moins performants.<\/p>\n\n\n\n<p>Entre <strong>2022<\/strong> et <strong>2023<\/strong>, selon la classe \u00e9nerg\u00e9tique (<strong>PEB D, E, F ou G<\/strong>), l\u2019indexation pouvait \u00eatre :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>partiellement autoris\u00e9e (75 % ou 50 %),<\/li>\n\n\n\n<li>ou totalement interdite.<\/li>\n<\/ul>\n\n\n\n<p>Ces dispositifs visaient un double objectif : prot\u00e9ger <strong>le pouvoir d\u2019achat des locataires<\/strong> dans un contexte inflationniste et inciter <strong>les bailleurs<\/strong> \u00e0 am\u00e9liorer <strong>la performance \u00e9nerg\u00e9tique<\/strong> de leurs biens.<\/p>\n\n\n\n<p>Ils ont profond\u00e9ment marqu\u00e9 <strong>les pratiques des propri\u00e9taires<\/strong> et ont introduit <strong>une complexit\u00e9 suppl\u00e9mentaire<\/strong> dans <a href=\"https:\/\/www.smovin.app\/fr-be\/fonctionnalites\/indexation-automatisee\/\"><strong>les calculs d\u2019indexation<\/strong><\/a>, encore perceptible aujourd\u2019hui.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"la-fin-des-restrictions\"><a href=\"#la-fin-des-restrictions\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>La fin des restrictions<\/h3>\n\n\n\n<p>Toutefois, <strong>ces restrictions<\/strong> ont \u00e9t\u00e9 supprim\u00e9es en 2023 dans les 3 r\u00e9gions (<strong>Flandre<\/strong> et <strong>Bruxelles<\/strong> en <strong>octobre 2023<\/strong> et <strong>Wallonie<\/strong> en <strong>novembre 2023<\/strong>).<\/p>\n\n\n\n<p>Cela marque un retour \u00e0 un cadre plus classique, mais les r\u00e8gles sp\u00e9cifiques appliqu\u00e9es pendant cette p\u00e9riode restent importantes \u00e0 conna\u00eetre, notamment pour v\u00e9rifier d\u2019<strong>anciennes indexations<\/strong> ou corriger d\u2019\u00e9ventuelles erreurs.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"bruxelles-le-facteur-de-correction\"><a href=\"#bruxelles-le-facteur-de-correction\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Bruxelles : le facteur de correction<\/h3>\n\n\n\n<p>Depuis le <strong>14 octobre 2023<\/strong>, <strong>l\u2019indexation des loyers<\/strong> pour les logements disposant d\u2019un certificat <strong>PEB E, F ou G<\/strong> est \u00e0 nouveau autoris\u00e9e \u00e0 <strong>Bruxelles<\/strong>, mais elle peut n\u00e9cessiter l\u2019application d\u2019<strong>un facteur de correction<\/strong>.<\/p>\n\n\n\n<p>Ce m\u00e9canisme concerne les logements qui remplissent les trois conditions suivantes :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>le bail<\/strong> est entr\u00e9 en vigueur <strong>avant le 14 octobre 2022<\/strong> ;<\/li>\n\n\n\n<li><strong>le logement<\/strong> poss\u00e8de un certificat <strong>PEB E, F ou G<\/strong> ;<\/li>\n\n\n\n<li>le bien est lou\u00e9 sur le <strong>march\u00e9 locatif priv\u00e9<\/strong> ou via certains <strong>dispositifs publics<\/strong> (commune, CPAS, agence immobili\u00e8re sociale, r\u00e9gie fonci\u00e8re).<\/li>\n<\/ul>\n\n\n\n<p>En revanche, certains acteurs comme <strong>les soci\u00e9t\u00e9s immobili\u00e8res de service public<\/strong> (SISP) ou le <strong>Fonds du Logement<\/strong> ne sont pas concern\u00e9s par ce dispositif.<\/p>\n\n\n\n<p>Concr\u00e8tement, cela signifie que, m\u00eame si <strong>l\u2019indexation<\/strong> est de nouveau autoris\u00e9e, le montant index\u00e9 peut \u00eatre <strong>r\u00e9duit<\/strong> par l\u2019application de <strong>ce facteur<\/strong>, afin de tenir compte de <strong>la mauvaise performance \u00e9nerg\u00e9tique<\/strong> du logement.<\/p>\n\n\n\n<p>Ce point reste souvent m\u00e9connu <strong>des bailleurs<\/strong> et peut entra\u00eener <strong>des erreurs de calcul<\/strong>. Il est donc essentiel de v\u00e9rifier si votre situation entre dans <strong>ce cadre sp\u00e9cifique<\/strong> avant d\u2019appliquer <strong>une indexation standard<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"lindexation-en-pratique-une-demarche-a-ne-pas-negliger\"><a href=\"#lindexation-en-pratique-une-demarche-a-ne-pas-negliger\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>L\u2019indexation en pratique : une d\u00e9marche \u00e0 ne pas n\u00e9gliger<\/h2>\n\n\n\n<p>Appliquer <strong>une indexation<\/strong> ne se r\u00e9sume pas \u00e0 faire un calcul. C\u2019est une d\u00e9marche encadr\u00e9e.<\/p>\n\n\n\n<p>Elle intervient \u00e0 une date pr\u00e9cise : <strong>l\u2019anniversaire du bail<\/strong>. \u00c0 partir de ce moment, <strong>le bailleur<\/strong> peut notifier <strong>le nouveau loyer au locataire<\/strong>.<\/p>\n\n\n\n<p>Cette notification doit \u00eatre claire et contenir :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>le nouveau <strong>montant<\/strong>,<\/li>\n\n\n\n<li><a href=\"https:\/\/statbel.fgov.be\/fr\/themes\/prix-la-consommation\/indice-sante\"><strong>les indices<\/strong><\/a> utilis\u00e9s,<\/li>\n\n\n\n<li>la <strong>date<\/strong> d\u2019application.<\/li>\n<\/ul>\n\n\n\n<p>Autre point cl\u00e9 : <strong>la r\u00e9troactivit\u00e9<\/strong> est limit\u00e9e \u00e0 <strong>3 mois<\/strong>. Un oubli prolong\u00e9 ne pourra donc pas \u00eatre totalement rattrap\u00e9.<\/p>\n\n\n\n<p>Cela montre une chose : <strong>l\u2019indexation<\/strong> doit \u00eatre <strong>suivie r\u00e9guli\u00e8rement<\/strong>, sinon elle devient <strong>une perte financi\u00e8re<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"les-erreurs-frequentes-a-eviter\"><a href=\"#les-erreurs-frequentes-a-eviter\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Les erreurs fr\u00e9quentes \u00e0 \u00e9viter<\/h2>\n\n\n\n<p>M\u00eame en <strong>2026<\/strong>, certaines erreurs restent courantes et peuvent avoir <strong>des cons\u00e9quences financi\u00e8res importantes<\/strong>.<\/p>\n\n\n\n<p>Parmi les plus fr\u00e9quentes :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>oublier d\u2019<strong>enregistrer le bail<\/strong><\/li>\n\n\n\n<li>utiliser <strong>un mauvais indice<\/strong><\/li>\n\n\n\n<li>appliquer <strong>une indexation sans notification<\/strong><\/li>\n\n\n\n<li>confondre <strong>anciennes r\u00e8gles PEB<\/strong> et r\u00e8gles actuelles<\/li>\n<\/ul>\n\n\n\n<p>Ces erreurs peuvent entra\u00eener :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>un <strong>refus<\/strong> de paiement<\/li>\n\n\n\n<li>un <strong>remboursement<\/strong> des montants per\u00e7us<\/li>\n\n\n\n<li>un <strong>litige<\/strong> avec le locataire<\/li>\n<\/ul>\n\n\n\n<p>Une gestion <strong>rigoureuse<\/strong> et <strong>document\u00e9e<\/strong> est donc indispensable pour \u00e9viter ces situations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"pourquoi-automatiser-lindexation-des-loyers\"><a href=\"#pourquoi-automatiser-lindexation-des-loyers\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Pourquoi automatiser l\u2019indexation des loyers ?<\/h2>\n\n\n\n<p>D\u00e8s que vous g\u00e9rez plusieurs biens, <strong>l\u2019indexation<\/strong> devient un sujet organisationnel. Entre r\u00e8gles g\u00e9n\u00e9rales, cas sp\u00e9cifiques, comme <strong>Bruxelles<\/strong>, et h\u00e9ritage des mesures PEB, une approche approximative peut vite entra\u00eener des erreurs.<\/p>\n\n\n\n<p>Pour <strong>les bailleurs<\/strong> comme pour <strong>les professionnels de l\u2019immobilier<\/strong>, l\u2019enjeu est double :<\/p>\n\n\n\n<ul
