glyphicon-link\"><\/i><\/a>Comment calculer l\u2019indexation du loyer en Belgique ?<\/h3>\n\n\n\n<p>Le <strong>calcul de l\u2019indexation<\/strong> repose sur la formule suivante :<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Loyer de base \u00d7 (nouvel indice sant\u00e9 \/ indice sant\u00e9 de d\u00e9part) = Loyer index\u00e9<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"des-regles-dindexation-differentes-selon-les-regions-belges\"><a href=\"#des-regles-dindexation-differentes-selon-les-regions-belges\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Des r\u00e8gles d\u2019indexation diff\u00e9rentes selon les r\u00e9gions belges<\/h2>\n\n\n\n<p>En Belgique, <strong>l\u2019indexation des loyers<\/strong> repose sur un principe f\u00e9d\u00e9ral commun : l\u2019\u00e9volution de <strong>l\u2019indice sant\u00e9<\/strong>.<\/p>\n\n\n\n<p>Toutefois, ces derni\u00e8res ann\u00e9es, les r\u00e9gions ont temporairement introduit <strong>des restrictions sp\u00e9cifiques<\/strong>, notamment en lien avec la <strong>performance \u00e9nerg\u00e9tique<\/strong> des logements (<strong>PEB<\/strong>), avant d\u2019y mettre fin r\u00e9cemment.<\/p>\n\n\n\n<p>Entre 2022 et 2023, la <strong>Wallonie<\/strong>, la R\u00e9gion de <strong>Bruxelles-Capitale<\/strong> et la <strong>Flandre<\/strong> avaient instaur\u00e9 des <strong>limitations \u00e0 l\u2019indexation<\/strong> des loyers pour les logements les <strong>moins performants<\/strong> sur le plan \u00e9nerg\u00e9tique.<\/p>\n\n\n\n<p>Selon la <strong>classe PEB<\/strong> (D, E, F ou G), l\u2019indexation pouvait \u00eatre <strong>partiellement autoris\u00e9e<\/strong> (75 % ou 50 %), voire <strong>totalement interdite<\/strong>, afin d\u2019inciter les bailleurs \u00e0 entreprendre des r\u00e9novations \u00e9nerg\u00e9tiques.<\/p>\n\n\n\n<p>Ces mesures exceptionnelles ont d\u00e9sormais pris fin dans toutes les r\u00e9gions :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>en <strong>Wallonie<\/strong> depuis le <strong>1\u1d49\u02b3 novembre 2023<\/strong>,<\/li>\n\n\n\n<li>\u00e0 <strong>Bruxelles<\/strong> depuis le <strong>14 octobre 2023<\/strong>,<\/li>\n\n\n\n<li>en <strong>Flandre<\/strong> depuis le <strong>1\u1d49\u02b3 octobre 2023<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Depuis ces dates, <strong>l\u2019indexation des loyers<\/strong> est \u00e0 nouveau pleinement autoris\u00e9e, quelle que soit <strong>la classe PEB<\/strong> du logement, \u00e0 condition de respecter <strong>les r\u00e8gles classiques<\/strong> :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>indexation annuelle,<\/li>\n\n\n\n<li>bail enregistr\u00e9,<\/li>\n\n\n\n<li>notification correcte au locataire,<\/li>\n\n\n\n<li>application de la formule l\u00e9gale bas\u00e9e sur l\u2019indice sant\u00e9.<\/li>\n<\/ul>\n\n\n\n<p>Pour les <strong>bailleurs<\/strong> et les <strong>gestionnaires immobiliers<\/strong>, ces \u00e9volutions successives illustrent l\u2019importance de <strong>suivre attentivement les changements r\u00e9glementaires<\/strong> r\u00e9gionaux.<\/p>\n\n\n\n<p>Une <strong>indexation<\/strong> appliqu\u00e9e hors p\u00e9riode autoris\u00e9e ou selon des r\u00e8gles devenues obsol\u00e8tes peut entra\u00eener des <strong>contestations<\/strong>, voire l\u2019obligation de rembourser les montants ind\u00fbment per\u00e7us.<\/p>\n\n\n\n<p><strong>Des <\/strong><a href=\"https:\/\/www.smovin.app\/fr-be\/fonctionnalites\/indexation-automatisee\/\"><strong>outils de gestion locative<\/strong><\/a> comme Cette notification doit mentionner :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>le <strong>nouveau montant<\/strong> du loyer,<\/li>\n\n\n\n<li>l\u2019<strong>indice<\/strong> de <strong>d\u00e9part<\/strong>,<\/li>\n\n\n\n<li>l\u2019<strong>indice<\/strong> <strong>appliqu\u00e9<\/strong>,<\/li>\n\n\n\n<li>la <strong>date<\/strong> de prise <strong>d\u2019effet<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>En pratique, <strong>l\u2019indexation<\/strong> ne peut produire ses effets que pour <strong>les trois mois pr\u00e9c\u00e9dant<\/strong> la demande. Un <strong>bailleur<\/strong> qui oublie d\u2019indexer pendant plusieurs ann\u00e9es ne pourra donc pas <strong>r\u00e9clamer r\u00e9troactivement<\/strong> l\u2019int\u00e9gralit\u00e9 des montants non index\u00e9s.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"eviter-les-litiges-lies-a-lindexation-des-loyers\"><a href=\"#eviter-les-litiges-lies-a-lindexation-des-loyers\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>\u00c9viter les litiges li\u00e9s \u00e0 l\u2019indexation des loyers<\/h3>\n\n\n\n<p>De nombreux litiges li\u00e9s \u00e0 <strong>l\u2019indexation<\/strong> trouvent leur origine dans <strong>des erreurs<\/strong> pourtant \u00e9vitables. Parmi les plus courantes :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>indexer un loyer <strong>sans clause pr\u00e9vue<\/strong> au bail,<\/li>\n\n\n\n<li>utiliser un <strong>mauvais indice sant\u00e9<\/strong>,<\/li>\n\n\n\n<li>appliquer une <strong>indexation r\u00e9troactive excessive<\/strong>,<\/li>\n\n\n\n<li><strong>oublier l\u2019enregistrement<\/strong> du bail,<\/li>\n\n\n\n<li>ne pas tenir compte des <strong>restrictions r\u00e9gionales<\/strong> ou <strong>\u00e9nerg\u00e9tiques<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Les risques encourus en cas d\u2019erreur sont multiples : <strong>refus de paiement<\/strong> par le locataire, obligation de <strong>remboursement<\/strong>, d\u00e9gradation de la <strong>relation locative<\/strong>, voire <strong>contentieux<\/strong> <strong>judiciaire<\/strong>.<\/p>\n\n\n\n<p>Pour limiter ces risques, <strong>une gestion rigoureuse et outill\u00e9e de l\u2019indexation<\/strong>, int\u00e9grant les r\u00e8gles l\u00e9gales en vigueur et un historique fiable des calculs, est aujourd\u2019hui <strong>indispensable<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"indexation-manuelle-ou-indexation-automatique\"><a href=\"#indexation-manuelle-ou-indexation-automatique\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Indexation manuelle ou indexation automatique ?<\/h2>\n\n\n\n<p>Pour un <strong>bailleur<\/strong> poss\u00e9dant un seul bien, <strong>l\u2019indexation manuelle<\/strong> peut sembler suffisante.
