Cela veut dire qu\u2019en mati\u00e8re de bail de mani\u00e8re g\u00e9n\u00e9rale, il n\u2019y a rien \u00e0 respecter comme forme. Un cong\u00e9 m\u00eame verbal pourrait suffire.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Il existe une exception pour les biens d&#8217;habitation uniquement en <\/span><b>r\u00e9gion wallonne<\/b><span style=\"font-weight: 400;\"> : il est pr\u00e9vu que le cong\u00e9 doit \u00eatre notifi\u00e9 par <\/span><b>courrier recommand\u00e9 ou par exploit huissier.<\/b><span style=\"font-weight: 400;\"> S&#8217;il est notifi\u00e9 autrement, alors il n&#8217;est pas valable. Cette r\u00e8gle n&#8217;est pas applicable \u00e0 Bruxelles ou en Flandre.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">M\u00eame si \u00e0 Bruxelles et en Flandre, il n&#8217;y a pas de r\u00e8gle de forme qui sont prescrites \u00e0 peine de nullit\u00e9 du cong\u00e9, il faudra garder \u00e0 l&#8217;esprit qu&#8217;il va falloir <\/span><b>prouver le cong\u00e9<\/b><span style=\"font-weight: 400;\">. Il est donc conseill\u00e9 de faire un \u00e9crit, que ce soit pour le bailleur ou pour le locataire.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Concernant les r\u00e8gles de fonds, il n\u2019y a pas d\u2019\u00e9l\u00e9ments qui doivent obligatoirement se trouver dans le cong\u00e9.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Il est important que l\u2019on puisse d\u00e9duire la volont\u00e9 de mettre fin au bail. En mati\u00e8re de bail de r\u00e9sidence principale, il faut quand m\u00eame notifier \u00e0 l&#8217;avance l&#8217;intention de mettre fin au bail.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Dans un bail de 9 ans, il faut notifier (pour le bailleur) <\/span><b>6 mois avant la fin<\/b><span style=\"font-weight: 400;\"> que l\u2019on compte mettre fin au bail \u00e0 l&#8217;issue de cette p\u00e9riode de 9 ans.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Quand c&#8217;est un bail de 3 ans ou moins,le cong\u00e9 doit \u00eatre communiqu\u00e9 <\/span><b>3 mois avant la fin du bail.<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Pourquoi est-ce que cette r\u00e8gle existe ? S&#8217;il s&#8217;agit d&#8217;un bail de 3 ans ou moins, le bail sera alors consid\u00e9r\u00e9 comme un<\/span><b> bail de 9 ans.<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Pour les baux de 3 ans ou moins, il existe une exception : il peut \u00eatre pr\u00e9vu dans le bail qu\u2019il sera reconduit pour la <\/span><b>m\u00eame dur\u00e9e.<\/b><span style=\"font-weight: 400;\"> Dans ce cas, un bail de 3 ans ou moins ne se transformera pas en bail de 9 ans.\u00a0<\/span><span style=\"font-weight: 400;\">Cette r\u00e8gle ne vaut que pour la <\/span><b>premi\u00e8re reconduction<\/b><span style=\"font-weight: 400;\">. Car, si \u00e0 l&#8217;issue de la deuxi\u00e8me reconduction, il y a une nouvelle reconduction tacite, alors ce bail sera un bail de 9 ans. facult\u00e9 de mettre fin au bail en cours de bail et avant la fin naturelle du bail.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Pour le bailleur, il y a trois motifs de fin de bail :<\/span><\/p><ul><li><span style=\"font-weight: 400;\">Fin de bail pour occupation personnelle<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fin de bail pour gros travaux\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fin de bail sans motif.\u00a0<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Dans le bail, il est possible de pr\u00e9voir que le bailleur <\/span><b>renonce \u00e0 ses facult\u00e9s de r\u00e9siliation<\/b><span style=\"font-weight: 400;\"> concernant les 3 motifs pr\u00e9c\u00e9dents, ce qui n&#8217;est pas possible pour le preneur.<\/span><\/p><p><span style=\"font-weight: 400;\">Pour le preneur, il y a deux motifs de fin de bail :\u00a0<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sans motif\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Contre-pr\u00e9avis <\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section
