Cependant, bien que les restrictions aient \u00e9t\u00e9 lev\u00e9es, l&#8217;indexation des loyers des biens ayant un PEB D, E et F, ainsi que des biens n&#8217;ayant pas de PEB, se calcule \u00e0 l&#8217;aide d&#8217;une formule adapt\u00e9e. Ceci dans le but d\u2019\u00e9viter que les propri\u00e9taires ne rattrapent l\u2019indexation perdue.&nbsp;<\/p>\n\n\n\n<p>L\u2019indexation des loyers en Flandre d\u00e9pendait, depuis le 1\u1d49\u02b3 octobre 2022, du certificat PEB du bien. En effet, certains labels permettaient une indexation totale, d\u2019autres une indexation partielle, et les plus mauvais PEB ne permettaient aucune indexation.&nbsp;<\/p>\n\n\n\n<p>La r\u00e8gle \u00e9tait la suivante :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Les PEB de cat\u00e9gorie A, B et C pouvaient \u00eatre index\u00e9s \u00e0 100%<\/li>\n\n\n\n<li>Les PEB de cat\u00e9gorie D ne pouvaient \u00eatre index\u00e9s qu\u2019\u00e0 50%<\/li>\n\n\n\n<li>Les PEB de cat\u00e9gorie E, F et inconnus ne pouvaient plus \u00eatre index\u00e9s<\/li>\n<\/ul>\n\n\n\n<p>Ces restrictions n\u2019existent plus depuis le 1\u1d49\u02b3 octobre 2023 et la r\u00e9gion flamande a mis en place une nouvelle m\u00e9thode de calcul. Dans cette nouvelle m\u00e9thode, la formule habituelle de l\u2019indexation sera multipli\u00e9e par un <strong>facteur de correction<\/strong>, qui sera diff\u00e9rent en fonction du <strong>PEB du bien<\/strong> et de la <strong>date d\u2019anniversaire du bail<\/strong>.&nbsp;<\/p>\n\n\n\n<p>L\u2019indexation avec la formule adapt\u00e9e (facteur de correction) est \u00e0 appliquer si :&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le bien est lou\u00e9 \u00e0 titre de logement principal (l\u2019indexation n\u2019est pas applicable aux logements sociaux et aux contrats de location pour \u00e9tudiants)<\/li>\n\n\n\n<li>Le bail est entr\u00e9 en vigueur avant le 1\u1d49\u02b3 octobre 2022<\/li>\n\n\n\n<li>Le PEB du bien est D, E, F ou le bien n\u2019a pas de PEB<\/li>\n<\/ul>\n\n\n\n<p>Ces trois caract\u00e9ristiques \u00e9taient \u00e9galement celles concern\u00e9es par le gel des loyers jusqu\u2019au 30 septembre 2023.&nbsp;<\/p>\n\n\n\n<p>D\u00e9couvrez comment Smovin <strong><a href=\"https:\/\/www.smovin.app\/fonctionnalites\/indexation-automatisee\/\">simplifie l&#8217;indexation de vos loyers<\/a> <\/strong>en automatisant le calcul et la notification au locataire.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"calculer-lindexation-du-loyer-en-flandre-selon-la-peb\"><a href=\"#calculer-lindexation-du-loyer-en-flandre-selon-la-peb\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Calculer l\u2019indexation du loyer en Flandre selon la PEB<\/h2>\n\n\n\n<p>Pour calculer <strong>l\u2019indexation du loyer en Flandre<\/strong>, il faut prendre en compte le <strong>loyer hors charges<\/strong>,<strong> l\u2019indice sant\u00e9<\/strong> ainsi que le <strong>facteur de correction<\/strong>. Attention, le facteur de correction d\u00e9pend du label PEB du bien ainsi que de la date d\u2019anniversaire du bail.&nbsp;<\/p>\n\n\n\n<p>Le calcul sera le suivant :&nbsp;nouveau loyer index\u00e9 = nouveau loyer index\u00e9 hors restriction x facteur de correction&nbsp;<\/p>\n\n\n\n<p>Pour rappel, le calcul du loyer index\u00e9 hors restriction est le suivant :&nbsp;nouveau loyer index\u00e9 hors restriction = (loyer de base x nouvel indice) \/ indice de base&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" class=\"wp-block-heading\" 1\u1d49\u02b3 janvier 2023 et le 30 septembre 2023, le <strong>facteur de correction simplifi\u00e9<\/strong> est le suivant : 0,5 x [(indice 2022 + indice 2023) \/ indice 2023]<\/p>\n\n\n\n<p>O\u00f9&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L\u2019indice 2022 correspond \u00e0 l\u2019indice sant\u00e9 du mois pr\u00e9c\u00e9dant l\u2019entr\u00e9e en vigueur du bail en 2022<\/li>\n\n\n\n<li>L\u2019indice 2023 correspond \u00e0 l\u2019indice sant\u00e9 du mois pr\u00e9c\u00e9dant l\u2019entr\u00e9e en vigueur du bail en 2023<\/li>\n<\/ul>\n\n\n\n<p><strong>Exemple :&nbsp;<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le montant du loyer de base est de 500 euros&nbsp;<\/li>\n\n\n\n<li>Le bail a d\u00e9but\u00e9 en mars 2019<\/li>\n<\/ul>\n\n\n\n<p>Pour calculer l\u2019indexation, il faut proc\u00e9der en deux \u00e9tapes&nbsp;<\/p>\n\n\n\n<p>1) La premi\u00e8re \u00e9tape est de calculer le loyer index\u00e9&nbsp;<\/p>\n\n\n\n<p>Nouveau loyer = (loyer de base x nouvel indice \/ indice de base)&nbsp;<\/p>\n\n\n\n<p>O\u00f9&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L\u2019indice
