Il devra respecter une proc\u00e9dure stricte pour faire sa demande. <\/p>\n\n\n\n<p>Celle-ci pourra dans certains cas \u00eatre refus\u00e9e par le propri\u00e9taire. On vous explique tout ci-dessous. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"le-locataire-peut-il-ceder-son-bail-commercial\"><a href=\"#le-locataire-peut-il-ceder-son-bail-commercial\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Le locataire peut-il c\u00e9der son bail commercial ? <\/h2>\n\n\n\n<p>En Belgique, le propri\u00e9taire ne peut l\u00e9galement pas s&#8217;opposer \u00e0 la cession ou sous-location d&#8217;un bail commercial pour autant que la cession du lieu s&#8217;accompagne de la cession du fonds de commerce. <\/p>\n\n\n\n<p>Le propri\u00e9taire peut tout de m\u00eame<strong> s&#8217;opposer <\/strong>dans 2 cas : <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Si le propri\u00e9taire ou des membres de sa famille <strong>habite dans une partie  des lieux<\/strong><\/li>\n\n\n\n<li>Si le locataire est pr\u00e9sent dans les lieux depuis <strong>moins de 2 ans<\/strong> ou que son bail a \u00e9t\u00e9 renouvel\u00e9 il y a moins de 2 ans<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"comment-ceder-un-bail-commercial\"><a href=\"#comment-ceder-un-bail-commercial\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Comment c\u00e9der un bail commercial ? <\/h2>\n\n\n\n<p>Quelques \u00e9tapes sont n\u00e9cessaires pour que la cession puisse avoir lieux :<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Le locataire doit <strong>notifier le propri\u00e9taire<\/strong> de son d\u00e9sire de cession ou sous-location par recommand\u00e9 ou par huissier. Il doit \u00e9galement y joindre un projet de contrat de cession. <\/li>\n\n\n\n<li>Le propri\u00e9taire b\u00e9n\u00e9ficie alors de <strong>30 jours pour r\u00e9agir<\/strong> s&#8217;il d\u00e9sire s&#8217;opposer \u00e0 la cession ou la sous-location. Sans r\u00e9action de sa part, la demande du locataire sera consid\u00e9r\u00e9e comme accept\u00e9e. <\/li>\n\n\n\n<li>En cas d&#8217;opposition du bailleur, le locataire b\u00e9n\u00e9ficie de <strong>15 jours pour r\u00e9agir<\/strong> \u00e0 son tour. Si les 2 parties trouvent un accord, la cession sera alors effective. Par cons\u00e9quent, les droits et obligations du locataires s&#8217;appliquent au c\u00e9dant comme au nouveau locataire du bien commercial. <\/p>\n\n\n\n<p>Cela veut dire qu&#8217;en cas d&#8217;impay\u00e9 par le nouveau locataire, le propri\u00e9taire peut se retourner vers le preneur initial. <\/p>\n\n\n\n<p>Cette solidarit\u00e9 ne sera cependant plus effective en cas de renouvellement du bail.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"sous-location-du-bail-commercial\"><a href=\"#sous-location-du-bail-commercial\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Sous-location du bail commercial<\/h2>\n\n\n\n<p>La sous-location du bail commercial \u00e0 une personne tierce est possible aux<strong> m\u00eames conditions que pour une cession<\/strong>. La dur\u00e9e de la sous-location ne peut pas s&#8217;\u00e9tendre au-del\u00e0 de la dur\u00e9e initiale du bail. <\/p>\n\n\n\n<p>Le sous-locataire s&#8217;il d\u00e9sire renouveler le bail, devra passer par<strong> l&#8217;interm\u00e9diaire du locataire principale<\/strong>. C&#8217;est ce dernier qui adressera la demande au propri\u00e9taire. <\/p>\n\n\n\n<p>D&#8217;autre part, la sous-location du bien devient une <strong>cession<\/strong> si elle s&#8217;accompagne de la sous-location du commerce.
