<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"resiliation-du-bail-par-le-locataire\"><a href=\"#resiliation-du-bail-par-le-locataire\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>R\u00e9siliation du bail par le locataire<\/h3>\n\n\n\n<p>Dans le cas habituel d&#8217;un bail commercial de 9 ans, le locataire peut d\u00e9cider de r\u00e9silier le bail \u00e0 l&#8217;expiration de chaque &#8220;triennat&#8221; c&#8217;est-\u00e0-dire <strong>tous les 3 ans<\/strong>. <\/p>\n\n\n\n<p>Il devra adresser sa demande par recommand\u00e9 ou exploit d&#8217;huissier au plus tard<strong> 6 mois<\/strong> avant la fin de la p\u00e9riode triennale aussi appel\u00e9e &#8220;break&#8221;.<\/p>\n\n\n\n<p>Un <strong>pr\u00e9avis de 6 mois<\/strong> devra alors \u00eatre respect\u00e9. <\/p>\n\n\n\n<p>Au terme des 9 ans, la r\u00e9siliation est automatique, sauf si le locataire d\u00e9sire <a href=\"https:\/\/www.smovin.app\/bail-commercial\/renouvellement\"><strong>renouveler le bail<\/strong><\/a>. Il devra alors prendre action dans ce sens si le bail le permet.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"resiliation-du-bail-par-le-proprietaire\"><a href=\"#resiliation-du-bail-par-le-proprietaire\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>R\u00e9siliation du bail par le propri\u00e9taire<\/h3>\n\n\n\n<p>Le propri\u00e9taire peut de son c\u00f4t\u00e9, mettre fin au bail, si cette possibilit\u00e9 a \u00e9t\u00e9 pr\u00e9vue dans le contrat. <\/p>\n\n\n\n<p>La dur\u00e9e du <strong>pr\u00e9avis<\/strong> sera <strong>d&#8217;un an<\/strong>. De plus, ce dernier ne peut r\u00e9silier le contrat de bail<strong> que s&#8217;il pr\u00e9voit lui-m\u00eame<\/strong> ou un membre de sa famille, de reprendre le bien pour y exercer <strong>une activit\u00e9 de commerce<\/strong> ou d&#8217;artisanat. <\/p>\n\n\n\n<p>Cette activit\u00e9 devra s&#8217;exercer dans les 6 mois suivant la lib\u00e9ration du bien. Si ce n&#8217;est pas le cas, l&#8217;ancien locataire pourra r\u00e9clamer une indemnit\u00e9 \u00e9quivalente \u00e0 36 mois de loyer au propri\u00e9taire. <\/p>\n\n\n\n<p>Le bailleur peut \u00e9galement mettre fin au bail \u00e0 tout moment sans motif sp\u00e9cifique, moyennant le paiement d&#8217;une indemnit\u00e9 d&#8217;\u00e9viction \u00e9gale \u00e0 3 ans de loyer au locataire.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"resiliation-dun-commun-accord\"><a href=\"#resiliation-dun-commun-accord\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a> R\u00e9siliation d&#8217;un commun accord<\/h3>\n\n\n\n<p>La r\u00e9siliation du bail peut \u00e9galement avoir lieu d&#8217;un commun accord par les 2 parties. Un acte authentique est cependant fortement recommand\u00e9 (devant le notaire ou devant le juge).  <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"rompre-un-bail-avant-la-fin-dune-periode-triennale\"><a href=\"#rompre-un-bail-avant-la-fin-dune-periode-triennale\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Rompre un bail avant la fin d&#8217;une p\u00e9riode triennale<\/h2>\n\n\n\n<p>Il n&#8217;est normalement pas possible de r\u00e9silier un bail avant la fin des 3 ans. Il existe cependant 3 situations dans lesquelles un <strong>bail peut \u00eatre cass\u00e9<\/strong> en cours de p\u00e9riode :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Une clause permettant au locataire de r\u00e9silier son bail \u00e0 tout moment existe dans le contrat.<\/li>\n\n\n\n<li>Un accord mutuel entre les 2 parties a lieu. La r\u00e9siliation devra dans tous les cas \u00eatre act\u00e9e devant un notaire ou un juge. <\/li>\n\n\n\n<li>Le locataire peut c\u00e9der son bail \u00e0 une autre personne qui reprendrait alors le contrat de bail. Cette 2\u1d49 solution ne fonctionne que si le contrat autorise la cession du bail \u00e0 une personne tierce.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"que-se-passe-t-il-en-cas-de-vente-du-bien-commercial\"><a href=\"#que-se-passe-t-il-en-cas-de-vente-du-bien-commercial\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Que se passe-t-il en cas de vente du bien commercial? <\/h2>\n\n\n\n<p>La vente du bien va dans certains cas pouvoir entrainer la r\u00e9siliation du bail. Les r\u00e8gles vont varier selon :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Les clauses du contrat,<\/li>\n\n\n\n<li>Si le contrat est enregistr\u00e9 ou non.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"le-bail-est-enregistre\"><a href=\"#le-bail-est-enregistre\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Le bail est enregistr\u00e9<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le contrat ne contient <strong>pas de clause<\/strong> permettant au nouvel acqu\u00e9reur d&#8217;expulser son locataire.<strong> Rien ne change<\/strong> pour le locataire, si ce n&#8217;est qu&#8217;il devra payer le loyer au nouveau propri\u00e9taire. <\/li>\n\n\n\n<li>Le contrat <strong>pr\u00e9voit<\/strong> qu&#8217;en cas de vente ou transmission du bail commercial, le nouvel acqu\u00e9reur a la <strong>possibilit\u00e9 d&#8217;expulser<\/strong> le locataire pr\u00e9sent. Certaines contraintes s&#8217;appliquent malgr\u00e9 tout : le nouveau bailleur devra notifier le locataire dans les <strong>3 mois <\/strong>apr\u00e8s son acquisition et devra respecter un <strong>pr\u00e9avis d&#8217;un an<\/strong>. Le nouveau propri\u00e9taire devra \u00e9galement verser une <strong>indemnit\u00e9 d&#8217;\u00e9viction<\/strong> au locataire.  <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"le-bail-nest-pas-enregistre\"><a href=\"#le-bail-nest-pas-enregistre\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Le bail n&#8217;est pas enregistr\u00e9<\/h3>\n\n\n\n<p>Il arrive qu&#8217;un bail commercial ne soit pas enregistr\u00e9. Dans ce contexte, 2 nouvelles possibilit\u00e9s : <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le locataire occupe le bien<strong> depuis moins de 6 mois<\/strong>, le nouveau propri\u00e9taire pourra expulser le locataire. <\/li>\n\n\n\n<li>Le locataire occupe les lieux <strong>depuis plus de 6 mois<\/strong>, le propri\u00e9taire pourra expulser le locataire en respectant les m\u00eames conditions que dans le cas d&#8217;un bail enregistr\u00e9 avec une clause permettant l&#8217;expulsion en cas de vente. Le propri\u00e9taire devra notifier le locataire dans les <strong>3 mois<\/strong> de l&#8217;achat du bien, respecter un<strong> pr\u00e9avis d&#8217;un an<\/strong>, payer une <strong>indemnit\u00e9 d&#8217;\u00e9viction<\/strong> au locataire. <\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"bail-commercial-et-faillite-du-preneur-que-faire\"><a href=\"#bail-commercial-et-faillite-du-preneur-que-faire\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>Bail commercial et faillite du preneur, que faire? <\/h2>\n\n\n\n<p>En cas de faillite du locataire d&#8217;un bail commercial, le curateur aura le<strong> droit de r\u00e9silier le bail<\/strong> sans condition et sans d\u00e9lai de pr\u00e9avis. Le bailleur pourra \u00e9ventuellement \u00eatre indemnis\u00e9 pour dommages et int\u00e9r\u00eats en fonction du montant disponible apr\u00e8s la liquidation de la faillite. <\/p>\n\n\n\n<p>Si le cas le permet, l&#8217;indemnit\u00e9 pourra aller jusqu&#8217;\u00e0 hauteur de l&#8217;indemnit\u00e9 de rupture pr\u00e9vue dans le bail, g\u00e9n\u00e9ralement un montant \u00e9quivalent \u00e0 6 mois de loyer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"noubliez-plus-jamais-de-date-importante-grace-a-un-outil-digital\"><a href=\"#noubliez-plus-jamais-de-date-importante-grace-a-un-outil-digital\" class=\"heading-link\"><i class=\"glyphicon glyphicon-link\"><\/i><\/a>N&#8217;oubliez plus jamais de date importante gr\u00e2ce \u00e0 un outil digital<\/h2>\n\n\n\n<p>Vous \u00eates propri\u00e9taire d&#8217;un parc immobilier comprenant diff\u00e9rents types de biens ?
